1. General Terms and Conditions
1.1. These Terms and Conditions set out the general terms, conditions and method of sales conducted by www.braskeantiaging.com (hereinafter referred to as the "Terms") of the online store www.braskeantiaging.com (hereinafter referred to as the "Online Store") are a legally binding document between the Buyer (hereinafter referred to as the "Buyer") and the Seller (hereinafter referred to as the "Seller"), which establishes the rights and obligations of the Buyer and the Seller.
1.2. The Buyer in these Terms is considered as a person who purchases Products in the Online Store www.braskeantiaging.com (hereinafter referred to as the "Buyer").
1.3. The seller of the Products (hereinafter referred to as the "Product" or "Products") available in the Online Store is UAB "Prieskoniai verslui," company code 302562788, VAT code LT100005737612, address: V.Nagevičiaus g. 3 LT-08237 Vilnius, Lithuania (hereinafter referred to as the "Seller").
1.4. The Seller and the Buyer together hereinafter referred to as the "Parties"
1.5. The Seller reserves the right to change, amend, or supplement the Terms at any time, taking into account the requirements of the legislation. The Buyer is informed about this on the website of the Online Store. The changes come into effect from the moment of publication and apply to all transactions concluded after the publication. Therefore, it is recommended that the Buyer familiarize themselves with the Terms before each purchase. The Buyer is bound by the Terms applicable at the time of placing the order in the Online Store.
1.6. The right to purchase Products in the Online Store is granted to:
1.6.1. capable natural persons, i.e., individuals who have reached the age of majority and whose legal capacity is not restricted according to the requirements of the applicable legislation;
1.6.2. minors from sixteen to eighteen years of age, only with the consent of their parents or guardians, except for cases where they are emancipated;
1.6.3. legal entities represented by a person acting in accordance with the founding documents of this legal entity;
1.6.4. authorized representatives of all the above-mentioned persons.
1.7. The essential Terms and information regarding the ordered Products are provided to the Buyer during the order placement process in the Online Store.
1.8. The Seller is released from any liability if the Buyer has not familiarized themselves, either partially or completely, with the Terms, although the opportunity to do so was provided.
2. Ordering and payment of Products
2.1. The Buyer, visiting the Online Store, selects the desired Products, based on which a Shopping Cart is formed. When placing an order, the Buyer must provide their Personal Information: name, surname, delivery address of the Products, correct telephone number, and email address, for the proper order execution.
2.2. By placing an order, the Buyer expresses their consent to these Terms and confirms that they (the Buyer) have the right to purchase Products in the Online Store and enter into a contract for their acquisition.
2.3. In all cases, before confirming the purchase order of Products in accordance with the procedure established in this section of the Terms and Conditions of Products Purchase and Sale, the Buyer must familiarize themselves with the currently applicable version of the Terms document at the time of placing the order and agree to them and comply with them. The purchase order of Products can only be submitted and received for processing by the Seller if the Buyer has familiarized themselves with and agrees to the Terms. In all other cases, when the Buyer disagrees with the Terms or a certain part of them, they do not have the right to order Products in the Online Store.
2.4. In order to enter into a Contract for the purchase of Products, the Buyer must perform the technical actions specified in the Online Store, as well as, following the notifications and/or links provided in the Online Store, the Buyer must submit a purchase order for Products to the Seller.
2.5. By familiarizing themselves with the Terms, agreeing to them, and committing to comply with them, the Buyer confirms that they do not object to the fact that the Terms will not be provided separately to the Buyer in writing (in paper form), unless otherwise agreed by the Parties. In all cases, if the Buyer wishes to review, save, and/or print the Terms, they can request them from the Online Store or contact the Seller by filling out the contact form available in the Online Store.
2.6. If the Buyer disagrees with these Terms or a part of them, they must not submit an order.
2.7. The prices of Products in the Online Store are indicated in Euros, including value-added tax (VAT).
2.8. The Buyer can make payment for the Products using their bank card through the STRIPE payment system.
2.9. The Seller sends the Buyer a VAT invoice via email address provided by the Buyer, VAT invoice is automatically generated based on the Buyer's information provided at the time of placing the order and cannot be changed after its issuance.
3. How the Purchase and Sale Agreement is Formed Between Seller and Buyer
3.1. The Agreement regarding the purchase and sale of Products is considered concluded between the Buyer and the Seller from the moment the Buyer, having selected the product/products, adds them to the shopping cart, completes all the order steps, and confirms the order by making the payment to the Seller. The purchase and sale agreement for Products becomes effective from the moment the Buyer pays the amount to the Seller's account.
3.2. The presentation of the Products for sale in the Online Store does not create any obligations for the Seller.
3.3. Along with the Buyer's purchase order of Products placed in the Online Store, these Terms and other applicable Terms become a legally binding Agreement concluded between the Buyer and the Seller, which is a mandatory legal document for both Parties of the Agreement.
4. Product Quality Guarantee
4.1. The characteristics of each product sold are indicated in the product description accompanying each item.
4.2. The Seller does not guarantee that the color, shape, and/or other parameters of the Products depicted in the Online Store may correspond to the real forms, colors, and/or other parameters due to the technical specifications of the Buyer's device. Therefore, if the Buyer requires more detailed information, advice, or instructions regarding the Products available in the Online Store, the Buyer may directly contact the Seller by filling out the contact form provided in the Online Store.
5. Shipping, Delivery and Price
5.1. The Buyer can choose one of the following methods of delivery:
5.1.1. Receive the ordered Products by registered post to the address specified by the Buyer. A tracking number and link to track the parcel will be supplied by the Buyer e-mail. A signature is required for delivery.In certain cases, package tracking may not be possible depending on the location and the local courier company.
5.1.2. Upon the Buyer's request, the Seller can send the Products using other shipping methods (International delivery couriers or Express delivery through special courier delivery service). In this case, the Buyer can contact the Seller through the contact form provided in the Online Store to arrange the delivery method and cost individually.
5.2. All orders placed in the Online Store are processed on business days, from Monday to Friday, from 8:00 to 16:00 hours. All orders placed in the Online Store are dispatched and delivered only on business days. If the item is in stock, it is prepared and shipped to the Buyer within 48 hours.Once the order is ready for shipment, the Seller informs the Buyer about it via the email address provided during the purchase.
5.3. The delivery time of the Products varies depending on the delivery address. The standard delivery by registered post usually takes:
5.3.1. 2-4 business days within Lithuania;
5.3.2. 5-15 business days within Europe;
5.3.3. 2-4 weeks in the United States and Canada;
5.3.4. From 4 weeks in Australia, Japan, China, and other countries.
5.4. The Seller sends parcel by registered post within Europe, the United States, and Canada. Shipping fees may vary depending on the specific location.
5.5. The Buyer, who has ordered Products and chosen "Home Delivery" as the delivery method, must accurately provide the exact delivery address for the Products, so that the Seller can properly fulfill the order. The Buyer receives the Products at the address specified during the order, and in the case the Buyer is not at home , the Buyer must collect the Products from the nearest Local Post Office or premises within the storage-pickup period specified by Local Post Office.
5.6. If it is impossible to deliver the Products to the Buyer due to reasons not caused by the Seller (e.g., if the Buyer provided an incorrect/wrong address or if the Buyer is not available at the address provided or if the Buyer decides not to collect the Products from the Local Post Office or premises within the storage-pickup period specified by Local Post Office) , the Seller may terminate the purchase and sale agreement. In this case the Products is returned ro the Seller. If the Seller terminates the purchase and sale agreement under this cause, the Seller refunds the amount paid by the Buyer for the Products within 14 days, deducting the costs incurred by the Seller for the re-delivery of the Products from the amount paid by the Buyer. The Seller transfers the refundable amount to the bank account specified by the Buyer during the ordering of the Products.
5.7. Before signing the documents for the delivery of the Products, the Buyer has the right to inspect the external packaging of the Products and, if it is damaged, also inspect the contents of the order, such as the packaging, quantity, quality, and assortment of the Products. If the Buyer notices any deficiencies or discrepancies between the shipment and the order, the Buyer must refuse to accept the shipment and fill out a special shipment inspection report, indicating the identified damages and notifying the Seller by completing a contact form on the Online Store. If the Buyer confirms the delivery documents without any remarks, it is considered that the Products were delivered to the Buyer in an undamaged package.
5.8. If there is at least one item in the Buyer's shopping cart that the Seller does not have in stock and the Seller cannot deliver to the Buyer within the specified timeframe, the Seller immediately informs the Buyer via the email provided during the order placement and provides an alternative delivery time for the Products. If the Buyer does not agree to the new delivery time for the Products, they can cancel their order. In this case, the Seller will refund the amount paid by the Buyer during the order placement within 14 days to the bank account specified by the Buyer during the ordering of the Products.
5.9. It is considered that the Products have been properly delivered to the Buyer when the document confirming the transfer-acceptance (delivery and/or receipt) of the Products is signed.
6. Import Duty
6.1. If the Buyer ordered Products from Online store for delivery outside of European Union, they may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. In this case the Buyer is responsible for payment of any such import duties and taxes. Please note that the Seller have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order.
6.2  Buyer must comply with all applicable laws and regulations of the country for which the products are destined. Seller will not be liable if Buyer break any such laws.
7. Refund policy, returns and exchanges
7.1 Products of suitable quality purchased in the Online Store can be returned and exchanged with the consent of the Seller. According to the Retail Trade Terms approved by the Minister of Economy of the Republic of Lithuania, food products of suitable quality, including food supplements, cannot be exchanged or returned.
7.2. Products of suitable quality may be returned (if applicable) within 14 days from the purchase date.
7.3 In case of returning the Products (if applicable), the Seller is obliged to refund full amount of the Products. Refund does not include the costs of the returning shipping and other costs connected with it. Buyer will receive a refund within 14 days of Buyers returned item's delivery day to the Seller. The refund will be credited to the Buyers original method of payment.
The refund is made to the Buyer within 14 (fourteen) calendar days from the day of returning the Products to the Seller, after making sure that the condition of the Products meets the conditions of return according to Terms 7.4. point.
7.4 Products of suitable quality may be returned (if applicable) only under the following conditions:
7.4.1 the returned item is in its original and neat packaging;
7.4.2 the product is not damaged by the Buyer;
7.4.3 the product is unused and has not lost its commercial appearance, the product label, protective film, etc. are intact;
7.4.4 Item is returned in the same composition as it was received by the Buyer (including documentation and delivery note) together with the gifts received for the purchase.
7.4.5. Returns must be sent to the following address by registered post before expiry of the 14-day return period: LABRASKE. UAB Pekitas. Statybininkų g. 5, LT-96155, Gargždai, Lithuania. Delivery risks and costs is always paid by the Buyer.
7.5 If the wrong Products were delivered to the Buyer, the Buyer must immediately, but not later than within 2 (two) working days from the receipt/acceptance of the shipment, inform the Seller about this through the contact form in the Online Store and submit all supporting documents. The Seller replace the wrong Products with the right Products. In that case the Seller does not have ordered Products in stock, Seller refunds for the Products to the Buyer. The refund is made to the Buyer within 14 (fourteen) calendar days from the day of returning the Products to the Seller, after making sure that the condition of the Products meets the conditions of return according to Terms 7.4. point.
7.5 Products of unsuitable quality are exchanged for Products of suitable quality or can be refunded within 14 days from the delivering to the Buyer day. The Buyer must immediately, but not later than within 2 (two) working days from the receipt/acceptance of the shipment, inform the Seller about this case through the contact form in the Online Store and submit all supporting documents. In that case the Seller does not have Products in stock, Seller refunds for the Products to the Buyer. The refund is made to the Buyer within 14 calendar days from the delivery to the Buyer day.

8. Marketing measures applied by the seller

8.1 The Seller reserves the right, at its discretion, to introduce and/or cancel offers, promotions, games or change the prices of the Products published in the Online Store or any material or content of the Online Store at any time.
9. Exchange of information
9.1 The Seller sends all notifications to the e-mail address provided during the Buyer's registration or when ordering Products in accordance with the procedure established by these Terms and the Privacy Policy.
9.2 The Buyer submits all his messages and questions to the Seller through the contact form in the Online Store.
10. Personal data protection
10.1 Personal data protection conditions are included in Privacy Policy.
11. Final provisions
11.1 The Buyer and the Seller agree that all disputes, disagreements and claims arising from these Terms related to their implementation, violation, termination or invalidity shall be resolved through negotiations. If an agreement cannot be reached through negotiations, disputes are resolved in accordance with the procedure established by legal acts.
11.2 In the event of a dispute, the Buyer should first contact the Seller, and the dispute resolution dispute has the right to contact the electronic consumer dispute resolution platform https://ec.europa.eu/consumers/odr/main/index.cfm ?event= main.home.chooseLanguage 
11.4 In order to inform the Seller about a violation of the Terms for the purchase and sale of Products, if you have questions or claims regarding the requested assistance of the Seller in the interpretation of the Terms or their application, please refer to the contact form on the Online Store.
11.5 These terms and contracts for the purchase of products on Online Store are governed by Lithuanian law. Any dispute over or claims arising from these terms or any
contracts will be subject to the exclusive jurisdiction of the Lithuanian courts, although we retain the right to bring proceedings against you for breaking these terms or any contract in your country of residence or any other relevant country.
